UK PM's ex-spin doctor held by cops in perjury case

LONDON -- A former spokesman for Britain?s prime minister was?detained by police on Wednesday amid allegations he committed perjury while working as a tabloid editor for Rupert Murdoch ? a move that brings the phone-hacking scandal closer to the heart of government.

Andy Coulson, who worked as David Cameron's director of communications, was held in London by detectives investigating claims he committed perjury during a high-profile court case in Scotland involving a politician accused of taking part in adulterous, drug-fueled sex orgies at swingers' clubs.


Coulson, 44, was being transferred north from London to Glasgow, Scotland, for questioning on Wednesday, according to Britain?s Sky News.

Strathclyde Police issued a statement that said: "Officers from Strathclyde Police's Operation Rubicon team detained a 44-year-old man in London this morning under section 14 of the Criminal Procedure Scotland Act 1995 on suspicion of committing perjury before the High Court in Glasgow."

Coulson resigned from his job as the Cameron?s chief spin doctor in January 2011 amid growing public anger over the phone-hacking scandal.

Prior to working for Cameron, he was editor of the News of the World, the now-defunct Murdoch Sunday tabloid. He resigned from that job in 2007 - also over phone hacking.

Now he is implicated in another long-running saga ? that of Tommy Sheridan, a lawmaker and icon of left-wing Scottish politics.

Coulson gave evidence in a 2010 Glasgow High Court trial at which Sheridan was jailed for three years for lying under oath during his earlier defamation action against the News of the World in 2006, STV News reported.

Sheridan had won ?200,000 in damages over an article that said he had committed adultery, visited a swingers' club and taken part in drug-fueled orgies.

Giving evidence at the 2010 trial, Coulson denied being involved in, or aware of, any illegal activities, including phone hacking, the BBC reported.

Earlier this month, Coulson appeared in front of an ongoing inquiry into press standards where he revealed he still held shares in Murdoch?s News Corp. while working as working as Cameron?s director of communications.

Business Models: A Strategic Management Approach brings many familiar management models to bear on the elements of a business model. Author Allan Afuah examines effective business model design by exploring internal and external components as well as industry factors. He looks at market positioning , competitive landscape, resources and capabilities, pricing, revenue options, financing, and planning activities related to effective business model design.

Many of the elements Afuah covers (costs, resources, partners, revenue model, customer segments) map well to Alex Osterwalder?s Business Model Canvas. However, this textbook doesn?t cover distribution channels, which are a key element of the Business Model Canvas. Afuah approaches business models from corporate strategy, functional, operational and financial perspectives, but does not spend much time on marketing and sales. Unlike Osterwalder?s Business Model Generation,?Business Models won?t walk you through creating and testing a business model?it?s more like an owner?s manual than a cook book.

Positioning

For Afuah, ?a business model is a framework for making a profit? and each element of the business model is evaluated in terms of its ability to contribute to that goal. To make a profit, a firm must either offer its products at a lower cost than its competitors or occupy a premium position in the market through differentiation so Afuah begins by examining positioning.

A firm can position itself as either a low-cost provider or as a differentiated by features, reputation, physical location, timing, and other factors. Low-cost positioning is typically the result of optimization around cost structure, supply chain, and operations. Differentiation is in relation to competitors and benefits customers perceive as important.

The book illustrates positioning relative to competitors along dimensions that are relevant to customers using multi-dimensional scaling. The customer?s perceptions of benefits form the X and Y axis of a graph; products and companies can then be graphed for relative position.

Pricing and Revenue Models

Pricing is an important consideration because positioning alone does not provide the means necessary for a profitable business model. Afuah covers common pricing strategies such as skimming and penetration along with rationale for price cuts and increases. Although value pricing pricing at the customer?s reservation price is ideal, its usually possible, so many companies default to cost-plus pricing.

Once a pricing strategy has been established, sources of revenue can be identified:

  • direct product or service sales (product sales, subscriptions, fee-for-service, markup, commission)
  • post-sale services
  • indirect content sales (e.g., advertising is sold to create media like TV, radio, and magazines)
  • product financing (e.g., automobile financing, GE Capital)
  • collect-early, pay-later financing (e.g., Dell Direct where the customer pays first and then the PC is manufactured)
  • intellectual property royalties (e.g., licenses)

Afuah uses the familiar Growth-Share Matrix and the GE/McKinsey matrix as tools to evaluate revenue models. These are essentially portfolio management tools which can help with investment decisions.

Segmentation

Afuah covers customer segmentation to ensure a match between revenue model and market. Consumers can be segmented by demographics, psychographics, behavior, geography or a combination of factors. Selecting the right target involves asking questions about market size, affordability, competition (Five Forces), and internal readiness.

Internal and External Factors

From an operational perspective, examining the value chain within which a company exists is important. The concept of a value chain spans the Partners and Activities boxes on the Business Model Canvas. Reviewing the value chain can give insight into cost reduction opportunities as well as new value creation possibilities.

When discussing resources and capabilities, which are equivalent to the Key Resources box on the Business Model Canvas, Afuah uses the VRISA (value, rareness, imitability, substitutability, and appropriability) framework as an evaluation tool. A higher rating on these attributes increases the chances of a profitable business model.

To successfully execute on a business model, organizational structure, systems, processes, and people need to be aligned. Changing a business model means changing your operating model.

Business Model Evolution

Afuah presents an interesting framework for business model evolution: block, run, and team-up. Blocking consists of defending a firm?s business model from competitors; running requires continually innovating a business model to stay ahead of the pack; teaming-up involves finding complementary partners to strengthen a business model. In all cases, companies must innovate. Innovation and change can be incremental, radical, disruptive, systemic, or dynamic. Disruptive innovation is best described in Clayton Christensen?s The Innovator?s Dilemma. Systemic change is a value chain perspective that seeks to take into account all consequences and impacted elements of innovation. Dynamic change describes the idealized scenario of ?curve-jumping? where, once a technology or product matures, a new one is waiting to take its place.

Costs

Like the Business Model Canvas, Afuah calls out costs as a separate category to evaluate. He advises using a value chain, value network, or value shop approach to assess cost structure. A value chain portrays the flow of resources that the firm participates in and allows the firm to understand its role in the final customer deliverable. A value network depicts the broader ecosystem of players involved in the industry. A value shop can help identify the range of services and value that an organization provides.

Afuah identifies a set of five cost drivers ordered by stage of the business system: research & development, product design, manufacturing and operations, marketing and sales, and distribution. Each cost driver is affected by the industry the company is in along with internal considerations.

The Seven C?s

Because ?too often, firms spend time performing strategic planning without really understanding the reasons behind success or failure?, Afuah includes a ?Seven C?s? framework. These seven components form the backbone of the book and are elaborated in each chapter.

  • Competitive Position ? is the firm lowest cost or differentiated?; what market segments are served?; what are sources of revenues?; what is the pricing model?
  • Connected Activities ? what is the value chain?; how does it contribute to profitability?
  • Competitive Forces ? how do Porter?s Five Forces play into profitability?; what other macro environmental factors are relevant?
  • Critical Industry Value Drivers ? what drives cost?; what influences differentiation?
  • Capabilities ? VRISA analysis
  • Change and Sustainability ? how does the firm innovate its offerings and business model?
  • Cost of Activities ? what are primary costs and how can they be reduced?

The book also covers various financing and valuation models for determining the funding required for operating a business. To finance a business, a business must choose the right type of investor and present a convincing case for funding. Afuah includes some considerations for selecting the timing and type of investment to seek.

In terms of planning, Afuah advises using a standard strategic planning process and using the Seven C?s model as the basis of the business plan.

The book concludes with a set of ten in-depth case studies which dissect the business model challenges of companies including Borders, eBay, and LEGO. Although not targeted at startups or business model reinvention specifically, the book uses many familiar management theories as building blocks of a comprehensive business model. As an academic treatment of business models, it works well and provides many diagnostic and discovery tools. It?s a thorough workbook for evaluating all aspects of a profitable business model.

What would a sexual revoltion look like (part one)? | Astrology Blog ...

We currently stand in the legacy of a half-formed sexual revolution of the 1960s. That was followed up by feminism, the Roe v Wade decision of the Supreme Court, a massive conservative backlash that included Abstinence-only sexual indoctrination, and of course AIDS. There are plenty of places where the sex is flowing freely, but is it the kind of sex you want? And as for what you now have available: is that the sex you want?

I ask these questions because we are in the midst of a quickening of erotic energy ? in part represented by a surge of eros associated with the Venus transit of the Sun, described by David Tresemer (his interview from UAC is re-posted in the audio link above).

Another astrological marker is the Uranus-Pluto square: we have come to a turning point in all things related to the 1960s and also the conservative backlash against them. One indication of this, in the sexual/relational sphere, is the crumbling of anti-gay laws and values. ?Don?t ask, don?t tell? was repealed last year, and state after state is adopting marriage equity laws (this despite the others that are adopting marriage purity laws).

Yet that?s just a small sample of the revolution in consciousness being spurred by Uranus-Pluto. There are many other signs and there will be many more ? which means opportunities to change, to grow and to participate personally. Today I put the question to Planet Waves readers who use Facebook: what would a sexual revolution look like? I was confident we would get some great answers, and we did. Here are some of them. I will hold off on sharing my own thoughts till tomorrow?s post, where we will continue the discussion.

Amanda Moreno wrote, ?A breakdown of the myth of the soul mate, which would evolve from its current sado-masochistic form (I?m not complete without you! Who am I without someone else to validate me? If I don?t find my one true love, I have failed!) into a more healing myth that respects curiosity, multiple models for healthy relationships and sexuality, and a focus on becoming complete/reliant/worthy within one?s own right first (enter in: the importance of masturbation among other things), and then extending that out to engage with the multitude of soul mates that might appear ? and maybe then disappear! ? throughout one?s life, learning more about the body/soul/spirit through expansive sexuality. Or something.?

Rebecca Brown wrote, ?I was part of that sexual revolution in the 60s, sitting topless and meditating by the Millstream in Woodstock. I?m not sure I would minimize its importance. However, true sexual revolution is like any type of evolution. It comes gradually with an opening of the lower chakras and accepting one?s sexual energy as being part of the total spiritual self and knowing what is right for yourself and allowing it to happen. I don?t think a sexual revolution would manifest as having everyone run around naked and engaging in orgies. Instead, there would be an inner peace about one?s sexuality, thus allowing others the same freedoms.?

Carrie wrote, ?Tamping down religious rhetoric about sex would be a big part of any sexual revolution. Religions have been responsible for a lot of the sexual repression and dysfunction in the world. Acceptance of female agency in sex and female control over her sexuality for a start. Less (or no) focus on genetic progeniture; that would help eliminate the controls on female fertility. Acceptance of sexual desire in both genders and allowing for the free expression (within healthy parameters of consenting adults). Acceptance of the sexuality of minors (babies are sexual beings and will grow up to be sexual beings) and promoting healthy education for them so they can become sexually aware and caring adults.?

Heleen Hoogma wrote, ?I hope a sexual revolution will have something to do with a change in the awareness of having power (of love) and passion and expression in whatever form one might choose to live it. I feel that power is a keyword in this (I don?t know why though).?

Candidly Lizzy wrote, ?A sexual revolution this time around would be one which eliminated boundaries (gender, orientation, race and age). It would be one in which the pairings of others ? in all their varieties would go as unrecognized as a spaceship driving down Lexington Ave. Target would begin selling toys design by Missoni, Mizrahi and Jonathan Adler. Perhaps even a special Dodson Collection at Macy?s. Marriages would be held together by emotional (and spiritual) contract, not a legal piece of paper. Legal papers will ONLY serve to recognize unions for tax and property purposes ? completely secular. People will be together with upfront (discussed) understandings as to whether they they are exclusive, periodic, sex-only, and they will make a point of knowing what they want rather than that being and after-the-fact consideration.?

Jennifer Hillman wrote, ?I feel that myth is breaking down in the reality of the changing aspects of relationships these days. Most of the men I know? don?t want to be ?tied down? to one person and feel the expression of the human sexuality is more along the line of ?love the one you?re with? attitude. Perhaps this is the begin of the sexual revolution.?

Chenoa Johnston wrote, ?A sexual revolution would look like a blasted open sensual and loving world! No sexual abuse in existence! Prostitution considered normal! The science of pleasure taught to the young at an early age! the elimination of shame and guilty sexual desire! Self-responsibility and accountability.?

Is Internet Marketing or Network Marketing A Better Way To Make ...

?

I make money doing both Internet marketing and network marketing. The question for a newbie trying to make money online is which way is better? Let?s answer that question.

1. Network marketing. I have found that it?s easier to build an MLM business when you incorporate Internet marketing into it.

The big advantage is in generating real prospects for your business. In the old days of network marketing you had to prospect in person or by phone.

This eliminated most people from ever really sponsoring anyone and building a large downline. Most people were never any good at handing out business cards, prospecting, identifying real prospects, setting an appointment, doing an MLM business presentation, following up, enrolling a new distributor, and teaching them how to do what you just did.

It?s actually amazing to think about people like Mark Yarnell with Nu Skin, Dexter Jaeger with Amway, Jan Rhue with Discovery Toys, and so on were as successful as they were. This is why John Milton Folgg wrote the best-selling MLM book titled ?The Greatest Networker? which is a parable about a young man ready to quit network marketing and what he learns to become successful at it.

In the past so much energy was spent on personal development because this was really the only way the average person was going to improve themselves to the point they would go through this whole process to build their business.

2. Internet marketing. Even with the advantages that the Internet provides most people still will never sponsor more than 1 or 2 people in their downline. The reason for this is using the Internet to build an MLM business takes online marketing skills.

It really doesn?t matter what the business model is. Until you learn how to get traffic to a website you are not going to make money.

Based on this fact network marketing companies are incorporating a lot of training on traffic generation. This can still mean using offline marketing methods with your warm market.

However, in building a meaningful MLM business, you will need to learn how to promote your system of prospecting, sponsoring, and training using the Internet. The exciting thing about this is once you learn how to do it you can be in multiple network marketing businesses at the same time.

You may not be comfortable with that. You might just want to focus on one and building it as large as you can.

However, once you start making money with your first network marketing business, today many Internet marketers will take on a second mlm opportunity. The key to making this work for you is to outsource the traffic generation.

You can still put your personal touch on following up with prospects yourself. But you don?t have to deal with anybody until they are a legitimate prospect. This is why network marketing is a great way to make money when you use Internet marketing to assist you in doing it.

TRENTON, N.J. (AP) ? A former Rutgers University student openly apologized for the first time on Tuesday for using a webcam to spy on a romantic liaison between a man and a roommate who later killed himself, saying he regrets his "thoughtless, insensitive, immature, stupid and childish choices."

Dharun Ravi, who had been criticized by a judge for not showing remorse and for refusing to say he was sorry, also said he will begin serving a 30-day jail term on Thursday even though he doesn't have to.

Through a lawyer, Ravi issued his most contrite public statement yet in a case that made him a symbol of what his family called an overzealous prosecution and that made his roommate, Tyler Clementi, a prime example of what gay rights advocates said were the consequences of bullying.

"I accept responsibility for and regret my thoughtless, insensitive, immature, stupid and childish choices that I made on Sept. 19, 2010, and Sept. 21, 2010," Ravi said in his statement. "My behavior and actions, which at no time were motivated by hate, bigotry, prejudice or desire to hurt, humiliate or embarrass anyone, were nonetheless the wrong choices and decisions. I apologize to everyone affected by those choices."

After spending two days repeatedly looking at the Twitter feed on which Ravi announced "I saw him making out with a dude. Yay," Clementi, a shy, talented violinist, threw himself from New York City's George Washington Bridge on Sept. 22, 2010.

In March, a jury convicted Ravi of all 15 criminal counts with which he was charged, including invasion of privacy and bias intimidation. On two of the intimidation counts, he faced up to 10 years in state prison.

Last week, a judge sentenced him to 30 days in jail. Because the sentence is less than a year, it decreases the chances that federal immigration authorities will seek to have Ravi deported to India, where he was born and remains a citizen.

Prosecutors, finding the sentence too lenient, said they would appeal.

Ravi's lawyers have said they expect to appeal the convictions entirely. They say that he was not hateful and that authorities charged him with such serious crimes because of Clementi's suicide even though he was not charged with the 18-year-old's death.

Ravi, 20, could have remained free during the appeal but instead is volunteering to head to the Middlesex County Jail in New Brunswick.

"It's the only way I can go on with my life," he said in the statement.

The apology comes as a sharp reversal in course for Ravi, whose story inspired hundreds of people to rally at New Jersey's State House calling for no prison time and changes in the state's hate crime laws.

When Ravi was sentenced, Judge Glenn Berman chastised him for not apologizing for his actions.

"I heard this jury say 'guilty' 288 times," the judge said, referring to all the sub-parts of the charges Ravi faced repeated 12 times, once for each juror. "And I haven't heard you apologize once."

During the court proceeding, Ravi, who had said in March in a newspaper interview that he was "very sorry about Tyler," chose not to address the judge, though he cried as his mother pleaded for mercy for him.

He told Newark's The Star-Ledger newspaper in an interview conducted before the sentencing but published afterward that he did not want to say he was sorry during the sentencing because he thought it would sound insincere.

During the sentencing, Clementi's brother James Clementi said that hearing an apology that late from Ravi would not be meaningful to him.

On Tuesday, the state's largest gay rights group, Garden State Equality, said it was happy Ravi had publicly apologized. But Chairman Steven Goldstein said the group was questioning the timing of the apology.

"We have mixed emotions, and so rather than take an organizational stance just yet, we have posited the question to our members on (the group's) Facebook page to ask what they think," Goldstein said.

Garden State Equality has said Ravi deserves more jail time than he received but "nowhere near" the maximum sentence he could have received.

"We have said that our hearts would be open to an apology had Ravi opened his heart up to us all," Goldstein said. "He could have apologized in a way that would not have compromised his legal position. But he came across to many of us as unremorseful both before the trial and in engineered media appearances after the verdict."

The insurance industry does not always have the best reputation. Relatively small companies holding huge amounts of wealth tend to make people nervous and uncomfortable, especially during economic recessions, and with companies given the same rights as individuals, there is naturally a public backlash against powerful companies.

Despite the fact that amassing wealth is by no means illegal (if it is done legally of course), the mere fact that there are people who are still prosperous financially when so many are suffering makes any company an easy scapegoat.

But even with an image issue that can easily dictate the profits and losses until the recession blows over, the way that the insurance industry has been constructed to work for the public good.

Insurance companies make money when policies are written. This is when customers pay their premiums and companies get a small influx of capitol. But when customers make claims and companies have to pay these claims, insurance companies lose money. So it is in an insurance company's best interest to prevent accidents that would cause customers to submit claims.

Therefore, insurance companies and those who promote public health and safety make for a natural alliance because it is in both parties' best interest to keep the public safe.

The goal of public health, as an entity of the government, is obviously to keep the public as safe as possible. This goal is reflected in laws passed after years of testing and often a public outcry. For example the seatbelt law requires everyone in a car to wear a seatbelt and the no smoking in restaurants law was put in place to mitigate the effects of second-hand smoke, just to name a few.

The passing of these laws has had major benefits for all types of insurance companies. After the seatbelt law was passed, fewer people were seriously injured or died in car accidents meaning that insurance companies have to pay out less money.

The same principle works for the anti-smoking law and health insurance companies. Fewer instances of the type of cancer that smoking causes mean fewer bills for health insurers. Naturally, the health and safety of the general public benefit from these laws, but also for insurance.

Certainly these types of policies benefit insurance companies much more overtly than independent insurance agents, but in an industry that is so centered on reputation, showing the public that insurance is really on their side and profits off of the public's well-being and not their losses will only help every aspect of the business, including agents.

UN agency has big concerns about Flame virus

A United Nations agency charged with helping member nations secure their national infrastructures plans to issue a sharp warning about the risk of the Flame computer virus that was recently discovered in Iran and other parts of the Middle East.

"This is the most serious (cyber) warning we have ever put out," said Marco Obiso, cyber security coordinator for the U.N.'s Geneva-based International Telecommunications Union.

The confidential warning will tell member nations that the Flame virus is a dangerous espionage tool that could potentially be used to attack critical infrastructure, he told Reuters in an interview on Tuesday.

"They should be on alert," he said, adding that he believed Flame was likely built on behalf of a nation state.

The warning is the latest signal that a new era of cyber warfare has begun following the 2010 Stuxnet virus attack that targeted Iran's nuclear program. The United States explicitly stated for the first time last year that it reserved the right to retaliate with force against a cyber attack.

Evidence suggests that the Flame virus may have been built on behalf of the same nation or nations that commissioned the Stuxnet worm that attacked Iran's nuclear program in 2010, according to Kaspersky Lab, the Russian cyber security software maker that took credit for discovering the infections.

"I think it is a much more serious threat than Stuxnet," Obiso said.

He said the ITU would set up a program to collect data, including virus samples, to track Flame's spread around the globe and observe any changes in its composition.

Kaspersky Lab said it found the Flame infection after the ITU asked the Russian company to investigate recent reports from Tehran that a mysterious virus was responsible for massive data losses on some Iranian computer systems.

So far, the Kaspersky team has not turned up the original data-wiping virus that they were seeking and the Iranian government has not provided Kaspersky a sample of that software, Obiso said.

Some skeptical
A Pentagon spokesman asked about Flame referred reporters to the Department of Homeland Security.

DHS officials declined to respond to specific questions about the virus, but an agency spokesman issued a brief written statement that said: "DHS was notified of the malware and has been working with our federal partners to determine and analyze its potential impact on the U.S."

Some industry participants appeared skeptical that the threat was as serious as the U.N. agency and Kaspersky had suggested.

Jeff Moss, a respected hacking expert who sits on the U.S. government's Homeland Security Advisory Council, said that the ITU and Kaspersky were "over-reacting" to the spread of Flame.

"It will take time to disassemble, but it is not the end of the Net," said Moss, who serves as chief security officer of the Internet Corporation for Assigned Names and Numbers, or ICANN, which manages some of the Internet's key infrastructure.

"We seem to be getting to a point where every time new malware is discovered it's branded 'the worst ever,'" said Marcus Carey, a researcher at with cyber security firm Rapid7.

Organizations involved in cyber security keep some of their communications confidential to keep adversaries from developing strategies to combat their defenses and also to keep other hackers from obtaining details about emerging threats that they could use to build other pieces of malicious software.

Mona was a diva. She carried her white-drizzled-with-black-spots fur with significance. She moved with slow grace and even the way she jumped on the wooden table where her food was had a whim of royalty.

I met Mona in the house we rented for the weekend in upstate New York where she was a cat.

Mona didn't require attention all the time, but when she did -- she requested it, or I could say demanded it. She started by walking towards me meowing. Then she rubbed against my leg and jumped on the sofa. She wiggled her sides against my shoulder and pushed her head against my hand. The next thing I knew, she was sitting on my lap and my hand was going back and forth through her fur. Mona was purring. That continued for some time. Then Mona jumped off my lap and, as if nothing had happened, slowly went minding her own business. I admit, for a moment I felt used.

My meeting with Mona occurred the day after I lead my first session on the topic How to live a work-of-art life while working in my company, a large consulting firm. It is great to talk about dreams, creative projects and discuss what brings passion to one's life. But it takes more than words to organize your life so that it has qualities of a work of art -- like being willing to ask for what you need. Some call it the ?unofficial? or ?informal? economy, others call it the ?grey economy? but the old name fits it best: the ?black economy?. In the USA ?black? means ?profitable, healthy? and this is what the black economy is. Macedonia should count its blessings for having had a black economy so strong and thriving to see it through the transition. If Macedonia had to rely only on its official economy it would have gone bankrupt long ago.

The black economy is made up of two constituent activities:

1.. Legal activities that are not reported to the tax authorities and the income from which goes untaxed and unreported. For instance: it is not illegal to clean someone?s house, to feed people or to drive them. It is, however, illegal to hide the income generated by these activities and not to pay tax on it. In most countries of the world, this is a criminal offence, punishable by years in prison.
2.. Illegal activities which, needless to say, are also not reported to the state (and, therefore, not taxed).
These two types of activities together are thought to comprise between 15% (USA, Germany) to 60% (Russia) of the economic activity (as measured by the GDP), depending on the country. It would probably be an underestimate to say that 40% of the GDP in Macedonia is ?black?. This equals 1.2 billion USD per annum. The money generated by these activities is largely held in foreign exchange outside the banking system or smuggled abroad (even through the local banking system). Experience in other countries shows that circa 15% of the money ?floats? in the recipient country and is used to finance consumption. This should translate to 1 billion free floating dollars in the hands of the 2 million citizens of Macedonia. Billions are transferred to the outside world (mostly to finance additional transactions, some of it to be saved in foreign banks away from the long hand of the state). A trickle of money comes back and is ?laundered? through the opening of small legal businesses.

These are excellent news for Macedonia. It means that when the macro-economic, geopolitical and (especially) the micro-economic climates will change ? billions of USD will flow back to Macedonia. People will bring their money back to open businesses, to support family members and just to consume it. It all depends on the mood and on the atmosphere and on how much these people feel that they can rely on the political stability and rational management. Such enormous flows of capital happened before: in Argentina after the Generals and their corrupt regime were ousted by civilians, in Israel when the peace process started and in Mexico following the signature of NAFTA, to mention but three cases. These reserves can be lured back and transform the economy.

But the black economy has many more important functions.

The black economy is a cash economy. It is liquid and fast. It increases the velocity of money. It injects much needed foreign exchange to the economy and inadvertently increases the effective money supply and the resulting money aggregates. In this sense, it defies the dictates of ?we know better? institutions such as the IMF. It fosters economic activity and employs people. It encourages labour mobility and international trade. Black economy, in short, is very positive. With the exception of illegal activities, it does everything that the official economy does ? and, usually, more efficiently.

So, what is morally wrong with the black economy? The answer, in brief: it is exploitative. Other parts of the economy, which are not hidden (though would have liked to be), are penalized for their visibility. They pay taxes. Workers in a factory owned by the state or in the government service cannot avoid paying taxes. The money that the state collects from them is invested, for instance, in infrastructure (roads, phones, electricity) or used to pay for public services (education, defence, policing). The operators of the black economy enjoy these services without paying for them, without bearing the costs and worse: while others bear the costs. These encourages them, in theory to use these resources less efficiently.

And all this might be true in a highly efficient, almost ideal market economy. The emphasis is on the word ?market?. Unfortunately, we all live in societies which are regulated by bureaucracies which are controlled (in theory, rarely in practice) by politicians. These elites have a tendency to misuse and to abuse resources and to allocate them in an inefficient manner. Even economic theory admits that any dollar left in the hands of the private sector is much more efficiently used than the same dollar in the hands of the most honest and well meaning and well planning civil servant. Governments all over the world distort economic decisions and misallocate scarce economic resources.

Thus, if the goals are to encourage employment and economic growth ? the black economy should be welcomed. This is precisely what it does and, by definition, it does so more efficiently than the government. The less tax dollars a government has ? the less damage it does. This is an opinion shares by most economists in the world today. Lower tax rates are an admission of this fact and a legalization of parts of the black economy.

The black economy is especially important in times of economic hardships. Countries in transition are a private case of emerging economies which are a private case of developing countries which used to be called (in less politically correct times) ?Third World Countries?. They suffer from all manner of acute economic illnesses. They lost their export markets, they are technologically backward, their unemployment skyrockets, their plant and machinery are dilapidated, their infrastructure decrepit and dysfunctional, they are lethally illiquid, they become immoral societies (obligations not honoured, crime flourishes), their trade deficits and budget deficits balloon and they are conditioned to be dependent on handouts and dictates from various international financial institutions and donor countries.

Read this list again: isn?t the black economy a perfect solution until the dust settles?

It enhances exports (and competitiveness through imports), it encourages technology transfers, it employs people, it invests in legitimate businesses (or is practised by them), it adds to the wealth of the nation (black marketeers are big spenders, good consumers and build real estate), it injects liquidity to an otherwise dehydrated market. Mercifully, the black economy is out of the reach of zealous missionaries such as the IMF. It goes its own way, unnoticed, unreported, unbeknownst, untamed. It doesn?t pay attention to money supply targets (it is much bigger than the official money supply figure), or to macroeconomic stability goals. It plods on: doing business and helping the country to survive the double scourges of transition and Western piousness and patronizing. As long as it is there, Macedonia has a real safety net. The government is advised to turn a blind eye to it for it is a blessing in disguise.

There is one sure medicine: eliminate the population and both unemployment and inflation will be eliminated. Without the black economy, the population of Macedonia would not have survived. This lesson must be remembered as the government prepares to crack down on the only sector of the economy which is still alive and kicking.

Operational Recommendations

The implementation of these recommendations and reforms should be obliged to be GRADUAL. The informal economy is an important pressure valve for the release of social pressures, it ameliorates the social costs inherent to the period of transition and it constitutes an important part of the private sector.

As we said in the body of our report, these are the reasons for the existence of an informal economy and they should be obliged to all be tackled:

a.. High taxation level (in Macedonia, high payroll taxes);
b.. Onerous la
bour market regulations;
c.. Red tape and bureaucracy (which often leads to corruption);
d.. Complexity and unpredictability of the tax system.
Reporting Requirements and Transparency

a.. All banks should be obliged to report foreign exchange transactions of more than 10,000 DM (whether in one transaction or cumulatively by the same legal entity). The daily report should be submitted to the Central Bank. In extreme cases, the transactions should be investigated.

a.. All the ZPP account numbers of all the firms in Macedonia should be publicly available through the Internet and in printed form.
a.. Firms should be obliged by law to make a list of all their bank accounts available to the ZPP, to the courts and to plaintiffs in lawsuits.
a.. All citizens should be obliged to file annual, personal tax returns (universal tax returns, like in the USA). This way, discrepancies between personal tax returns and other information can lead to investigations and discoveries of tax evasion and criminal activities.
a.. All citizens should be obliged to file bi-annual declarations of personal wealth and assets (including real estate, vehicles, movables, inventory of business owned or controlled by the individual, financial assets, income from all sources, shares in companies, etc.).
a.. All retail outlets and places of business should be required to install ? over a period of 3 years ? cash registers with ?fiscal brains?. These are cash registers with an embedded chip. The chips are built to save a trail (detailed list) of all the transactions in the place of business. Tax inspectors can pick the chip at random, download its contents to the tax computers and use it to issue tax assessments. The information thus gathered can also be crossed with and compared to information from other sources (see: ?Databases and Information Gathering?). This can be done only after the full implementation of the recommendations in the section titled ?Databases and Information Gathering?. I do not regard it as an effective measure. While it increases business costs ? it is not likely to prevent cash or otherwise unreported transactions.
a.. All taxis should be equipped with taximeters, which include a printer. This should be a licencing condition.
a.. Industrial norms (for instance, the amount of sugar needed to manufacture a weight unit of chocolate, or juice) should be revamped. Norms should NOT be determined according to statements provided by the factory ? but by a panel of experts. Each norm should be signed by three people, of which at least one is an expert engineer or another expert in the relevant field. Thought should be dedicated to the possibility of employing independent laboratories to determine norms and supervise them.
a.. Payments in wholesale markets should be done through a ZPP counter or branch in the wholesale market itself. Release of the goods and exiting the physical location of the wholesale market should be allowed only against presentation of a ZPP payment slip.
Reduction of Cash Transactions

a.. Cash transactions are the lifeblood of the informal economy. Their reduction and minimization is absolutely essential in the effort to contain it. One way of doing it is by issuing ZPP payment (debit) cards to businesses, firm and professionals. Use of the payment cards should be mandatory in certain business-to-business transactions.
a.. All exchange offices should be obliged to issue receipt for every cash transaction above 100 DM and to report to the Central Bank all transactions above 1000 DM. Suspicious transactions (for instance, transactions which exceed the financial wherewithal of the client involved) should be duly investigated.
a.. The government can reduce payroll taxes if the salary is not paid in cash (for instance, by a transfer to the bank account of the employee). The difference between payroll taxes collected on cash salaries and lower payroll taxes collected on noncash salaries ? should be recovered by imposing a levy on all cash withdrawals from banks. The banks can withhold the tax and transfer it to the state monthly.
a.. Currently, checks issued to account-holders by banks are virtually guaranteed by the issuing banks. This transforms checks into a kind of cash and checks are used as cash in the economy. To prevent this situation, it is recommended that all checks will be payable to the beneficiary only. The account-holder will be obliged to furnish the bank with a monthly list of checks he or she issued and their details (to whom, date, etc.). Checks should be valid for 5 working days only.
a.. An obligation can be imposed to oblige businesses to effect payments only through their accounts (from account to account) or using their debit cards. Cash withdrawals should be subject to a withholding tax deducted by the bank. The same withholding tax should be applied to credits given against cash balances or to savings houses (stedilnicas). Alternatively, stedilnicas should also be obliged to deduct, collect and transfer the cash withdrawal withholding tax.
a.. In the extreme and if all other measures fail after a reasonable period of time, all foreign trade related payments should be conducted through the Central Bank. But this is really a highly irregular, emergency measure, which I do not recommend at this stage.
a.. The interest paid on cash balances and savings accounts in the banks should be increased (starting with bank reserves and deposits in the central bank).
a.. The issuance of checkbook should be made easy and convenient. Every branch should issue checkbooks. All the banks and the post office should respect and accept each other?s checks.
a.. A Real Time Gross Settlement System should be established to minimize float and facilitate interbank transfers.
Government Tenders

a.. Firms competing for government tenders should be obliged to acquire a certificate from the tax authorities that they owe no back-taxes. Otherwise, they should be barred from bidding in government tenders and RFPs (Requests for Proposals).
Databases and Information Gathering

a.. Estimating the informal economy should be a priority objective of the Bureau of Statistics, which should devote considerable resources to this effort. In doing so, the Bureau of Statistics should coordinate closely with a wide variety of relevant ministries and committees that oversee various sectors of the economy.
a.. All registrars should be computerized: land, real estate, motor vehicles, share ownership, companies registration, tax filings, import and export related documentation (customs), VAT, permits and licences, records of flights abroad, ownership of mobile phones and so on. The tax authorities and the Public Revenue Office (PRO) should have unrestricted access to ALL the registers of all the registrars. Thus, they should be able to find tax evasion easily (ask for sources of wealth- how did you build this house and buy a new car if you are earning 500 DM monthly according to your tax return?).
a.. The PRO should have complete access to the computers of the ZPP and to all its computerized and non-computerized records.
a.. The computer system should constantly compare VAT records and records and statements related to other taxes in order to find discrepancies between them.
a.. Gradually, submissions of financial statements, tax returns and wealth declarations should be computerized and done even on a monthly basis (for instance, VAT statements).
a.. A system of informants and informant rewards should be established, including anonymous phone calls. Up to 10% of the intake or seizure value related to the information provided by the informant should go to the informant.
Law Enforcement

a.. Tax inspectors and customs officials should receive police powers and much higher salaries (including a percentage of tax revenues). The salaries of all tax inspectors ? regardless of their original place of employment ? should be equalized (of course, taking into consideration tenure, education, rank, etc.).
a.. Judges should be trained and educated in matters pertaining to the informal economy. Special courts for taxes, for instance, are a good idea (see recommendation below). Judges have to be trained in tax laws and the state tax authorities should provide BINDING opinions to entrepreneurs, businessmen and investors regarding the tax implications of their decisions and actions.
a.. It is recommended to assign tax in
spectors to the public prosecutors? office to work as teams on complex or big cases.
a.. To establish an independent Financial and Tax Police with representatives from all relevant ministries but under the exclusive jurisdiction of the PRO. The remit of this Police should include all matters financial (including foreign exchange transactions, property and real estate transactions, payroll issues, etc.).
a.. Hiring and firing procedures in all the branches of the tax administration should be simplified. The number of administrative posts should be reduced and the number of tax inspectors and field agents increased.
a.. Tax arrears and especially the interest accruing thereof should be the first priority of the ZPP, before all other payments.
a.. All manufacturers and sellers of food products (including soft drinks, sweetmeats and candy, meat products, snacks) should purchase a licence from the state and be subjected to periodic and rigorous inspections.
a.. All contracts between firms should be registered in the courts and stamped to become valid. Contracts thus evidenced should be accompanied by the registration documents (registrar extract) of the contracting parties. Many ?firms? doing business in Macedonia are not even legally registered.
Reforms and Amnesty

a.. A special inter-ministerial committee with MINISTER-MEMBERS and headed by the PM should be established. Its roles: to reduce bureaucracy, to suggest appropriate new legislation and to investigate corruption.
a.. Bureaucracy should be pared down drastically. The more permits, licences, tolls, fees and documents needed ? the more corruption. Less power to state officials means less corruption. The One Stop Shop concept should be implemented everywhere.
a.. A general amnesty should be declared. Citizens declaring their illegal wealth should be pardoned BY LAW and either not taxed or taxed at a low rate once and forever on the hitherto undeclared wealth.
The Tax Code

a.. To impose a VAT system. VAT is one the best instruments against the informal economy because it tracks the production process throughout a chain of value added suppliers and manufacturers.
a.. The Tax code needs to be simplified. Emphasis should be placed on VAT, consumption taxes, customs and excise taxes, fees and duties. To restore progressivity, the government should directly compensate the poor for the excess relative burden.
a.. After revising the tax code in a major way, the government should declare a moratorium on any further changes for at least four years.
a.. The self-employed and people whose main employment is directorship in companies should be given the choice between paying a fixed % of the market value of their assets (including financial assets) or income tax.
a.. All property rental contracts should be registered with the courts. Lack of registration in the courts and payment of a stamp tax should render the contract invalid. The courts should be allowed to evidence and stamp a contract only after it carries the stamp of the Public Revenue Office (PRO). The PRO should register the contract and issue an immediate tax assessment. Contracts, which are for less than 75% of the market prices, should be subject to tax assessment at market prices. Market prices should be determined as the moving average of the last 100 rental contracts from the same region registered by the PRO.
a.. Filing of tax returns ? including for the self-employed ? should be only with the PRO and not with any other body (such as the ZPP).
Legal Issues

a.. The burden of proof in tax court cases should shift from the tax authorities to the person or firm assessed.
a.. Special tax courts should be established within the existing courts. They should be staffed by specifically trained judges. Their decisions should be appealed to the Supreme Court. They should render their decisions within 180 days. All other juridical and appeal instances should be cancelled ? except for an appeal instance within the PRO. Thus, the process of tax collection should be greatly simplified. A tax assessment should be issued by the tax authorities, appealed internally (within the PRO), taken to a tax court session (by a plaintiff) and, finally, appealed to the Supreme Court (in very rare cases).
a.. The law should allow for greater fines, prison terms and for the speedier and longer closure of delinquent businesses.
a.. Seizure and sale procedures should be specified in all the tax laws and not merely by way of reference to the Income Tax Law. Enforcement provisions should be incorporated in all the tax laws.
a.. To amend the Law on Tax Administration, the Law on Personal Income Tax and the Law on Profits Tax as per the recommendations of the IRS experts (1997-9).
Customs and Duties

a.. Ideally, the customs service should be put under foreign contract managers. If this is politically too sensitive, the customs personnel should be entitled to receive a percentage of customs and duties revenues, on a departmental incentive basis. In any case, the customs should be subjected to outside inspection by expert inspectors who should be rewarded with a percentage of the corruption and lost revenues that they expose.
a.. In the case of imports or payments abroad, invoices, which include a price of more than 5% above the list price of a product, should be rejected and assessment for the purposes of paying customs duties and other taxes should be issued at the list price.
a.. In the case of exports or payments from abroad, invoices which include a discount of more than 25% on the list price of a product should be rejected and assessment for the purposes of paying customs duties and other taxes should be issued at the list price.
a.. The numbers of tax inspectors should be substantially increased and their pay considerably enhanced. A departmental incentive system should be instituted involving a percentage of the intake (monetary fines levied, goods confiscated, etc.).
a.. The computerized database system (see ?Databases and Information Gathering?) should be used to compare imports of raw materials for the purposes of re-export and actual exports (using invoices and customs declarations). Where there are disparities and discrepancies, severe and immediate penal actions should be taken. Anti-dumping levies and measures, fines and criminal charges should be adopted against exporters colluding with importers in hiding imported goods or reducing their value.
a.. Often final products are imported and declared to the customs as raw materials (to minimize customs duties paid). Later these raw materials are either sold outright in the domestic or international markets or bartered for finished products (for example: paints and lacquers against furniture or sugar against chocolate). This should be a major focus of the fight against the informal economy. I follow with an analysis of two products, which are often abused in this manner.
a.. I study two examples (white sugar and cooking oil) though virtually all raw materials and foods are subject to the aforementioned abuse.
a.. White Sugar is often imported as brown sugar. One way to prevent this is to place sugar on the list of LB (import licence required) list, to limit the effective period of each licence issued, to connect each transaction of imported brown sugar to a transaction of export, to apply the world price of sugar to customs duties, to demand payment of customs duties in the first customs terminal, to demand a forwarder?s as well as an importer?s guarantee and to require a certificate of origin. The same goes for Cooking Oil (which ? when it is imported packaged ? is often declared as some other goods).
a.. All payments to the customs should be made only through the ZPP. Customs and tax inspectors should inspect these receipts periodically.
a.. All goods should be kept in the customs terminal until full payment of the customs duties, as evidenced by a ZPP receipt, is
effected.
Public Campaign

a.. The government should embark on a massive Public Relations and Information campaign. The citizens should be made to understand what is a budget, how the taxes are collected, how they are used. They should begin to view tax evaders as criminals. ?He who does not pay his taxes ? is stealing from you and from your children?, ?Why should YOU pay for HIM?? ?If we all did not pay taxes- there would be no roads, bridges, schools, or hospitals? (using video to show disappearing roads, bridges, suffering patients and students without classes), ?Our country is a partnership ? and the tax-evader is stealing from the till (kasa)? and so on.
a.. The phrase ?Gray Economy? should be replaced by the more accurate phrases ?Black Economy? or ?Criminal Economy?.

Coroner: Gunman in Indiana standoff from Texas

VALPARAISO, Ind. -- A Texas man who took hostages in a northwestern Indiana realty office and held police at bay for several hours suffered three gunshot wounds before dying, likely from two different weapons, a coroner said torday.

Roy L. Ferguson, 48, of Fulshear, Texas, died at 6:30 p.m. Friday, Porter County Coroner Chuck Harris said. That was two hours after the end of the nearly seven-hour standoff at Prudential Executive Group Real Estate office in Valparaiso, about 40 miles southeast of Chicago.

"The likelihood of all three gunshot wounds coming from the same weapon is not good," Harris said. He said that wouldn't be confirmed until an autopsy is performed. It had not yet been scheduled because of Memorial Day weekend.

Valparaiso Police spokesman Sgt. Michael Grennes said Saturday that Ferguson had only one firearm - a handgun. Grennes also said the SWAT officers who rushed inside the office after hearing gunshots at 4:30 p.m. did not fire on Ferguson, but officers exchanged gunfire with Ferguson when the standoff started.

Asked Saturday if police had shot Ferguson, Grennes said, "It's under investigation."

Police received a 911 call around 10 a.m. Friday reporting a man with a gun had entered the brokerage office, Grennes said.

There were fewer than 10 people in the building when the incident began, he said.

One of them was accountant Carolyn Biesen. She was in her office when she heard a commotion near the front desk. Biesen walked out, saw a man standing over her injured co-worker on the ground and yelled at him to leave.

"That's when he pulled his gun out - and pointed it in the air," she told The Associated Press late Friday, several hours after she and several other people were taken hostage.

Biesen, 51, retreated back into her office, locked herself in, shoved a file cabinet in front of the door and called 911. Curled up under her desk, she heard two gunshots, then several more in rapid succession.

Ferguson, police said later, was looking for someone he believed owed him money when he went into the Prudential Executive Group Real Estate office in Valparaiso on Friday morning.

Valparaiso Police Chief Michael Brickner said officers believe Ferguson shot himself twice in the head before SWAT members broke windows and stormed inside less than two hours after the last two hostages had been released unharmed.

"He has some history here," Brickner said of Ferguson.

An ambulance rushed Ferguson to a hospital, where he died, police said.

No hostages reported being shot, though Grennes said one person who was struck in the head was treated and released from a hospital.

Another witness, Randy Baker, said he was in an adjacent parking lot shoveling asphalt when an officer wielding a pistol suddenly ran by and asked if he'd seen or heard anything about a gun. When Baker said he hadn't, the officer approached the building.

Seconds later, the officer began rapidly firing at least half a dozen times, said Baker, who took cover behind his work truck. He said he saw a woman in the Prudential window cowering under an office desk.

"That's what really scared me," Baker said. "And I ran out of there fast."

Mack Elliott, an agent at the brokerage, wasn't in the office Friday but said he spoke with agents who were present. He believes the incident stemmed from a dispute over a real estate transaction.

Biesen, the accountant, said she didn't believe the gunman intended to hurt her.

"If he wanted to, he could have come right into the office - maybe shooting through the door," she said.

Biesen spoke Friday night from her home, where several dozen family members and friends gathered after she had made it out unharmed. Despite the trauma, she said she felt sorry for the gunman, noting he could have decided to surrender after all the hostages were released.

"It's very sad," she said.
